&quot;Over the past several years, as various competitive moves in the growing business of comic conventions and pop culture shows have caused the phrase &quot;con war&quot; to become part of the standard industry lexicon, one of the most contentious and often litigious markets for conventions has been the city of Toronto. This week, that history earned a new chapter as Hobby Star Marketing – the company that puts on the annual &quot;Fan Expo Toronto&quot; show – has sued Wizard World, Inc. over its use of the name &quot;Toronto Comic Con&quot; for their show which just wrapped its latest outing last weekend at the Metro Toronto Convention Centre.<br />
<br />
In court filings obtained by CBR News, Hobby Star claims Wizard World and its newly installed CEO John Macaluso are improperly using the name, as Hobby Star claims rights to the term &quot;Toronto Comicon.&quot; That slight change in spelling may become very important in the future, though for now they've accused Wizard of &quot;passing off their services or business as or for those of the plaintiff&quot; and &quot;directing public attention to their services or business in such a way as to cause or be likely to cause confusion in Canada between their services or business and those of the plaintiff&quot; among other claims. Additionally, the suit claims that representatives of Wizard defamed Hobby Star by claiming to vendors that the company has threatened exhibitors with reprisals for trying to buy space at both shows.<br />
<br />
As a result, Hobby Star is asking for damages of $500,000 and repayment of all applicable legal fees.<br />
<br />
Hobby Star's claim centers around its own show, &quot;Toronto Comicon,&quot; which has in the recent past run both in April and at the Metro Toronto Convention Centre, with the latest running at the location March 10-11 of this year. Interestingly, Hobby Star hasn’t registered “Toronto Comicon” with the Canadian Intellectual Property Office, so it’s relying on common law to defend the mark. Its defense within the suit hinges on Wizard “Passing Off” their show through deceptive marketing practices outlined in Canadian intellectual property law. Within the suit, Hobby Star refers to their ownership of the name by “using the trade-mark and trade name&quot; on Toronto Comicon. To win the suit, the company will have to demonstrate there’s a goodwill and prestige associated with “Toronto Comicon,” not simply that they were first to use the name.<br />
<br />
This is the most recent turn in the legal right over the name &quot;Comic Con&quot; or its various spellings. For decades, conventions across the country used the term interchangeably to promote any and all local comic conventions, but in an era where the general public most readily identifies the term with Comic-Con International in San Diego (who own a copyright on the hyphenated version of the name), it's been a guessing game within the industry whether or not more strict competition would crop up over its use. For the past few years, many speculated Comic-Con International might take Wizard to court after the company rebranded all its shows as &quot;Comic Cons&quot; rather than their previous nomenclature as &quot;Wizard Worlds.&quot; While that never came to pass, this new case may not be the last such legal battle over the branding.<br />
<br />
More specifically to this case, Hobby Star is known as a shrewd player when it comes to defending its brand. From 2004 to 2007, the Toronto Fan Expo made waves in the local comics press thanks to a hard-lined booking feud with the smaller local show known as the Paradise Comicon. Things went silent when Wizard World bought Paradise in 2012 and rebranded it the Toronto Comicon while Hobby Star took to defending its biggest show from perceived infringement. However, the quiet period appears to have ended.<br />

			<content:encoded><![CDATA[<div>I thought I would give my opions/experience of Wizard Worlod Toronto from this past weekend April 14-15, 2012 at the MTCC in downtown Toronto.<br />
<br />
Let me preface this with we bought our weekend passes in advance (at a discount) and also a photo op with thye Being Human Cast in advance.<br />
<br />
Jax and I decided to head down to the convention to arrive at 9:00am ET as the doors opened at 10:00am ET.<br />
<br />
We got there just about 9am and the Registration Desks were open already (we walked right up and handed them outr pre-bought passes we printed out) and they put a weekend pass wristband on us (took all of 2 minutes for reg!) - OUTSTANDING!<br />
<br />
They had a lot of volunteers telling us where the line was (inside and up the escalator) - it was orderly and we were in the first line. - OUTSTANDING organization.<br />
<br />
At 10:00am ET the doors were opened and we were in less than 5 minutes later - OUTSTANDING!<br />
<br />
We got our Scott Bakula autograph and then headed over to get the 3 autographs from the Being Human actors (WW did not have a volunteer to help them - this was solved in less than 5 minutes) - EXCELLENT!<br />
<br />
We then lined up for our Being Human Photo op - the company running it were so organized and collected our printed out pre-bought ticket and gave us a card. My only &quot;complaint&quot; here was the area they wanted you to leave bags/coats/purses was not well monitored so that was a bit sketchy so we had friends hold our stuff instead. As for the photo op - totally smooth and a great picture turned out!<br />
<br />
We then went to talk to our friend Ian Rogers (author and he was Agent I at Polaris many years ago!) - he had his own table and my wife bought a book from him that he graciously autographed for us! He writes mainly horror novels/short stories!<br />
<br />
We then went to get autographs from the 2 Last Starfighter actors and literally theat took 1 minute (nol ine) - they were both wonderful and talkative (Lance Guest &quot;Alex&quot; and Catherine Mary Stewart &quot;Maggie&quot;) - FUN!<br />
<br />
We decided then to get our last autograph from Amy Acker &quot;Fred&quot; from Angel and that took about 10 minutes in line - nbot bad at all! She was sweet and chatted to us for a minute or so! GREAT EXPERIENCE!<br />
<br />
We then thought let's get a photo op with Amy Acker so we walked over and bought a photo op ticket - friendly staff and told us the line and took care of everything! Had another great photo taken!<br />
<br />
I would say &quot;OTHER&quot; conventions in Toronto could take a lesson on organization from WW Toronto as well as treating attendees with class and respect as well as their volunteers being knowledgeable and not having to &quot;get someone&quot; to answer simple questions. Oh and by the way WW volunteers smiled all the time and made it easy to deal with.<br />
<br />
WW brought some awesome guests and there wwere no &quot;crazy&quot; lines!<br />
<br />
The dealers area was not bad - nothing special but we did buy a couple of things and found a couple of things for our kids!<br />
<br />
I highly recommend WW to anyone thinking of attending!</div>
